Norwich cadet charged following keg party

A Norwich University cadet who attended a keg party in Killington has been charged with fondling a woman who was sleeping in a condominium.
Jorge Hernandez, 21, of Chicago pleaded innocent Monday in Rutland District Court to a charge of lewd and lascivious conduct. He was sent to jail for lack of $1,500 bail. If convicted, he faces up to five years in jail.
Public defender Richard Ammons said Hernandez thought the incident was consensual. “As soon as she told him to cut it out, he did,” Ammons said.
Hernandez was part of group of friends that rented three condos at the Alpine Trails Lodge in Killington, Ammons said.
“They started on a multiple keg party that night that went right through the weekend,” Ammons said.
The incident allegedly took place early Sunday morning, according to Vermont State Police. An 18-year-old woman told police she was asleep in a condo where she was staying with her boyfriend, according to the affidavit written by Trooper Samuel Capogrossi.
She told police her boyfriend was not there at the time. Hernandez climbed into bed with her as she was sleeping, Capogrossi wrote. The woman thought Hernandez was her boyfriend, according to the affidavit.
She said Hernandez started to kiss her, Capogrossi wrote. The woman said Hernandez pulled off her clothing and touched her, the trooper wrote.
She said that it wasn’t until she touched Hernandez’s hair that she realized he wasn’t her boyfriend, police wrote. The woman said she jumped out of bed and told him to get out of the room; he did, according to the affidavit.
Hernandez told police he did remember caressing the woman, according to Capogrossi’s report.
Asked if he pulled off her clothing, Hernandez responded, “That’s the thing, I don’t remember,” the trooper wrote.
In a related incident, a 21-year-old woman told police she found Hernandez in her condo. She told him to leave, and he did, according to the affidavit.
The 21-year-old woman told police that while waiting for police to arrive, her husband spotted Hernandez outside and struck him, according to an affidavit.
In court Monday Hernandez appeared to have a welt on the left side of his face.
Deputy State’s Attorney Peter Neary said cash bail was needed to ensure that Hernandez would return to face the charge. “What if he can’t go back to Norwich?” Neary asked. “If he goes back to Norwich and they say, ‘Clean out your locker,’ he has no reason to stay.”
Ammons said college officials would not comment on Hernandez’s status at the school, citing privacy concerns. “As far as he knows, he’s in good standing there,” Ammons said.
Judge Nancy Corsones set bail at $1,500.
With his hands and legs in cuffs, Hernandez was led away to the Rutland jail.
